Notice is hereby given that a public hearing will be held by the Clark County Board of Adjustment on Tuesday, July 7, 2026 at 9:00 A.M. in the Clark County Courthouse to consider in full or in part the following variance request by Aaron Christianson on his property described as Lot 3 in the Plat of Colonel's Landing in the Northwest Quarter of Section 13, Township 118 North, Range 58 West of the 5th P.M., Clark County, South Dakota.
- A Variance to Section 2.04.05.2: Area Regulations: Front Yard [Agricultural District]. The applicant requests a variance from the Right-of-way to construct a residence less than one hundred (100) from the right-of-way.
The physical location of this meeting is the Clark County Courthouse, 200 N. Commercial Street, Clark. Since it may be easier to remotely participate, this meeting will also be held virtually over a tele-conference platform. All persons interested in this matter may register to be heard before the Board of Adjustment during said hearing. I have been notified by one of neighbors of this construction project on a property near my Reid lake property. This entire project was completed under dubious circumstances; form an illegal boat launch, to a road change, then housing lots without reasonable setbacks for home sites.
Having several feet of variance is reasonable but more than 50 feet of variance on a project without seeking the variance before starting the project is a disregard to any rules. The landowner or general contractor should have known better or sought an adjustment BEFORE starting a project this far off from the listed distance.
I encourage the board to stop this project and provide the Colonel a copy of the guidelines for setbacks, otherwise every landowner can expect a variance after the fact for any distance in the future.
